Emergency of the Federal Energy Sector Extended
The emergency regarding generation, transport, and distribution of electric power; and transmission and distribution of natural gas is extended until July.
The Executive Branch published Emergency Decree 1023/2024 in the Official Gazette on November 20, 2024, extending the emergency in the federal energy sector until July 9, 2025. This emergency had been declared through Decree 55/2023 in December 2023.
Among other matters, this Emergency Decree:
- Establishes that the Secretary of Energy will continue implementing actions for:
(i) enforcing prices under competitive conditions and free access,
(ii) maintaining the real levels of income and the coverage of investment needs, to ensure the continued provision of public transportation and distribution services of electric power and natural gas under adequate technical and economic conditions for providers and users of all categories.
- Determines that the tariff schedules resulting from the tariff review for:
- the public utilities suppliers of transportation and electric power distribution in the federal jurisdiction,
- the transportation and distribution of natural gas, will be in force until July 9, 2025.
- Extends the intervention of the Federal Electricity Regulatory Agency (ENRE) and the Federal Gas Regulatory Agency (ENARGAS) until the Board members if the Federal Gas and Electricity Regulatory Entity—created through Law 27742, article 161—are established, appointed, and the Board is active.
- Orders that, once the Federal Gas and Electricity Regulatory Entity is established–replacing and taking over the functions of ENRE and ENARGAS–the Secretary of Energy will begin the members’ selection process.
