Salta Joins Fight Against Bullying

Law 8406, published in the Official Gazette of the Province of Salta on December 22, 2023, defines bullying as "any action or omission by one or more persons towards another that represents an aggression, mistreatment, repeated harassment; verbal, physical, and psychological violence; discrimination based on the characteristics of the person or their way of life, sexual orientation, gender identity, nationality, immigration status, ethnicity, sex, socioeconomic status, health status, disability, religious beliefs, opinions, practices based on social stigmas, pregnancy, among others, to inflict harm."
 

If the teaching staff and authorities of educational establishments detect a situation of bullying, they must:


1. maintain frequent communication with the parents and guardians of the aggressor student and the victim student,

2. implement an action protocol,

3. document and report cases of bullying to the school authority who, in turn, must report them to the enforcement authority,

4. indicate repair tasks—or others that may apply—to the aggressor student, so that they may reflect on their behavior,

5. carry out activities within the educational community to raise awareness of the problem.
 

The enforcement authority must conduct annual surveys of teachers, students, parents, and guardians, and prepare an annual report on the incidence of the bullying phenomena. It must also carry out studies and research that will serve as tools to design new policies on the matter.
