Recommendations from the AAIP for Online Purchases

On July 27, 28 and 29, 2020 the Hot Sale took place in Argentina. The Argentine Chamber of E-Commerce informed that during the first hour of the Hot sale, more than 135.000 participants were registered on the event’s official website, which represents an increase of 50% compared with the last edition.

In these circumstances, the Agency of Access to Public Information (the “AAIP” after its acronym in Spanish) elaborated a series of recommendations for users who make online purchases, namely:

1.  to check if the website is authenticated, meaning it comes from a hypertext transfer protocol secure (“https”) and not to submit personal data to sites that are not secure or are unknown.

2.  to not answer emails that request personal data, since it is one of the sources of contact frequently used to collect data without complying with the data protection law, infringing, as a result, the right to privacy.

3.  to read the terms and conditions of the website in order to acknowledge the purposes for which personal data will be used (in accordance with information requirements stablished in section 6 of Law No 25.326).

4.  acknowledge the rights granted by Law No 25.326 to data subjects, such as the possibility to make claims before the Directorate of Personal Data Protection of the Agency.
