Participatory Rulemaking Procedure Now Implemented

Participatory Rulemaking Procedure Now Implemented

General Resolution 2/2026, which entered into force on April 24, 2026, establishes the application—within the scope of the Public Registry of the City of Buenos Aires (IGJ)—of the Participatory Rulemaking procedure. This procedure was approved through Decree 1172/2003, which establishes mechanisms for public participation when drafting administrative regulations.

Resolution 2/2026 is part of the broader State reform and economic deregulation process promoted by the Federal Executive Branch and encourages a critical review of existing regulatory burdens to eliminate those that are obsolete, redundant, or constitute unnecessary obstacles to business activity. It also seeks to improve the technical quality of regulations, facilitate their implementation, and strengthen the legitimacy of governmental action.

The Participatory Rulemaking procedure establishes a broad and inclusive consultation process that enables citizens, professional and academic institutions, and any interested party to submit draft general resolutions to the IGJ which—due to their institutional relevance, regulatory impact, or public interest—warrant consideration. It also allows submitting comments, suggestions, or proposals to amend existing regulations.

Parties may submit their opinions and/or proposals through the website https://www.argentina.gob.ar/justicia/igj/consulta-publica, within the timeframe set for each call. Submitters must identify themselves and indicate the capacity in which they participate. Submissions will be non-binding. The relevant technical departments will analyze and consider the submissions when designing regulatory amendments.

Draft regulations, comments, and suggestions submitted under the Participatory Rulemaking procedure will be published on the agency’s official website, together with their supporting rationale and, where applicable, technical annexes.

The consultation currently open relates to General Resolution 15/2024, and contributions may be submitted until May 26, 2026.
