New AAIP Investigation
The Argentine Agency for Access to Public Information investigates alleged unlawful data processing in the context of debt collection.
The Argentine Agency for Access to Public Information (AAIP) has launched an investigation for alleged violations of Personal Data Protection Law 25326 (DPL) in connection with telephone debt collection. According to the AAIP, complaints received indicate that the company may have contacted relatives, friends, co-workers, and even neighbors of alleged debtors to demand payment of outstanding obligations.
As part of the investigation, the AAIP expressly reminded stakeholders that responsibility does not rest solely with debt collection agencies. Companies that disclose personal data to third parties for debt recovery may also be held liable. The DPL provides that recipients of personal data are subject to the same obligations as the entities that assign such data, and that both parties may be jointly and severally liable for potential infringements.
The AAIP’s action reinforces a broader trend toward more active regulatory oversight of business practices and strengthens expectations that companies adopt a proactive compliance approach.
