The new Decree establishes that tips will not be considered part of the worker’s pay and that consumers may pay them using electronic means.

Decree 731/2024 was published in the Official Gazette on August 13, 2024, modifying the concept of “tips” regulated in the Labor Law 20744. As of this Decree, tips will not be considered part of the salary.

This Decree also established that the businesses and/or establishments where employees customarily receive tips must give customers the option of tipping through electronic means. Further, tips will not be subject to deductions or perceptions.

Acquirers and/or aggregators offering their collection services in these stores and/or establishments must give their customers the option of paying the bill with the tip included, so that consumers can add an amount and/or a percentage to the bill as a tip.  Acquirers and/or aggregators will not charge an additional fee for providing this service.

The sums corresponding to tips must be credited to an account assigned for such purpose immediately or as soon as possible, as established by the Argentine Central Bank. The crediting may be direct to the worker receiving the tip or to a special collection account of the establishment for this exclusive purpose, but it must be made available to the worker within 24 hours after its crediting.

Finally, tips may not be used as a basis for adjusting or modifying workers basic salary, nor the working conditions the employer establishes.
