Suppliers Must Let Consumers Know of Product Recalls on Their Websites and Apps

For some time now, the Secretariat of Domestic Trade has been very active in the issuance of new regulations. Recently published Resolution 464/2022 directly impacts on the suppliers initiating product safety alerts and recalls. These are the proceedings that must be carried out by suppliers that become aware that, once launched into the market, a product or service could be potentially harmful to the consumers’ health or property.

 

This regulation addresses two main issues: (i) it establishes a form to standardize the way of making the initial notification to the authority, and (ii) it sets forth certain mandatory requirements to be included in the suppliers’ websites and apps.

 

What is the form about?

 

The form is a document with blanks to be filled out by those who need to make a filing with the authority as of June 30, 2022. The information required is mainly the same as the one required by the resolution that we commented here.

 

The recitals of the resolution state that this form is aimed at promoting compliance with the relevant regulation. Essentially, the mechanism for proving compliance with the regulation has been standardized, which will in theory make the Authority's monitor and control task more efficient.

 

What links must be included on the website and the apps?

 

The resolution establishes two additional measures to let consumers know of product safety alerts and recalls on the website and the apps of those who initiate these proceedings. These two links have a specific format established by the authority and it is mandatory to include them conspicuously, in a clear and legible way.  Suppliers have time to adapt to the new regulation up until August 27, 2022.
