The Agency of Access to Public Information Participates in the 46th Meeting of the Consultative Committee of Convention 108 of the Council of Europe

The meeting provided an opportunity for local authorities, observer organizations, and relevant stakeholders to discuss the status of the Convention 108+ ratifications.

The Agency of Access to Public Information Participates in the 46th Meeting of the Consultative Committee of Convention 108 of the Council of Europe

Convention 108+ is a multilateral instrument, binding for all parties, that seeks to adapt the provisions of Convention 108 to the new challenges facing the protection of personal data. In this way, it aims to protect the privacy of individuals from potential abuses during the processing of their data.

The Head of the Agency of Access to Public Information (AAIP), Beatriz Anchorena, participated in the meeting, representing Argentina. There, she presented these developments regarding data protection in Argentina:

  1. The European Commission's ratification of Argentina's status as an adequate country for the international transfer of personal data. After completing an evaluation process that began in 2018 with the entry into force of the General Data Protection Regulation (GDPR), in a report published on January 15, 2024, the European Commission ratified Argentina and 10 others as countries with an adequate levels of data protection. In deciding so, special emphasis was placed on the Personal Data Protection Bill the AAIP drafted, which aims to strengthen the Argentine legal framework for data protection.
  2. The work carried the AAIP carried out during 2023 as part of the Executive Committee of the Ibero-American Data Protection Network (RIPD), particularly in the Worldcoin, ChatGPT, Digital Violence, and Neurodata work groups.
  3. The AAIP’s role as Chair of the Strategic Steering Subcommittee of the Global Privacy Assembly (GPA), where it led the design of the Strategic Plan (2023-2025) and coordinated the work groups, creating actual tools to strengthen the protection of personal data in areas related to artificial intelligence, employment, research, and health data at a global level.

During the meeting, the third module of the Model Contractual Clauses for international data transfers was discussed and adopted, and the challenges from the emergence of neuro-technologies were assessed.
