Ruling on the Use of AI in Court Filings

A court identified inconsistencies in a filing allegedly generated using AI and emphasized that such tools cannot replace lawyers’ intellectual work.

Ruling on the Use of AI in Court Filings

A court in the Province of Salta issued a warning to a lawyer regarding the improper and unsupervised use of texts allegedly generated through the use of AI, after identifying conceptual and regulatory errors in a court filing. The court clarified that the use of AI tools is not prohibited. However, it emphasized that such tools cannot replace the lawyer’s intellectual contribution or professional responsibility (“Portal, José Antonio v Ruiz, Ramona del Carmen; Portal, Luis Alberto; Portal, Luis Miguel re interdict proceedings”, Case No. 908362/25, decision dated December 12, 2025).

The warning was issued by the Court of First Instance in Civil, Commercial, and Labor Matters of Joaquín V. González, in the context of a motion for reconsideration. In its decision, the court noted that the filing had serious deficiencies, including incorrect legal references and erroneous attributions to provisions of the Provincial Code of Civil and Commercial Procedure.

According to the ruling, these inconsistencies suggest that the submission may have been generated using AI or, alternatively, that it lacked the counsel’s adequate legal review and correction. As a result, the court instructed the attorney to refrain from using AI-generated texts without rigorous legal oversight or, if the filing was personally drafted, to conduct a thorough review of the applicable procedural rules.

Finally, the court acknowledged that AI may serve as a valuable tool to improve professional efficiency. Nevertheless, it warned that the uncontrolled use of such technologies may lead to nonexistent or inaccurate content—commonly referred to as “hallucinations”—which may harm the parties involved in the proceedings, undermine the administration of justice, and raise ethical concerns in the practice of law.
