ENACOM Regulates Postal Service
The new Resolution creates a transparent framework for actors involved in the postal activity.
Resolution 935/2025 of the Argentine Communications Agency (ENACOM) was published in the Official Gazette on June 27, 2025, approving a comprehensive update of the postal regime in line with the changes introduced by Decree 1005/2024.
Firstly, the Resolution regulates the procedure for registering as a postal service provider before ENACOM. Those interested in engaging in postal market activities must apply through the Remote Procedures Platform (TAD) in the registry ENACOM administers, by submitting the required information as a sworn statement regarding the postal activity to be carried out, in accordance with the digital form available on said platform.
The Resolution further provides that if applicants modify any of the information they declared at the time of registering, they must report this to ENACOM within 30 calendar days, also through TAD. They also must submit an annual sworn statement before March 15 or the next business day. This statement which must include information on the number of shipments, staff, billing, and other indicators. Any inaccuracy, falsehood, or omission of data or information submitted in a sworn statement will be sanctioned according to the Postal Law 20216.
Secondly, through the Resolution, ENACOM approves the operational and technical rules governing postal services. Among other matters, it regulates:
- The compensation regime for loss, damage, or misplacement of mail, parcels, or declared value shipments.
- The liability of operators in cases of delays or unrendered services.
- Exceptions in cases of force majeure, fault of the sender or depositor, the nature of the content, or prohibited shipments, among other specific scenarios.
- Provisions regarding the rights and obligations of postal operators.
Finally, the Resolution establishes that ENACOM will publish a monthly list of registered postal service providers on its official website and will update it regularly.
