ENACOM Approves Payment Facilities Regime
The regime allows regularizing obligations due through December 31, 2025.
Resolution 3/2026 of the Argentine Communications Agency (ENACOM), published in the Official Gazette on January 19, 2026, approves a Payment Facilities Regime aimed at regularizing various outstanding debts of licensees, authorized entities, permit holders, and other parties subject to the Information and Communications Technologies (ICT) Services regulatory framework.
The regime allows regularizing obligations due through December 31, 2025, including radio spectrum fees; the control, inspection, and verification fee; investment contributions to the Universal Service Fund; and fines imposed for breaches related to ICT services. It also covers interest and ancillary charges corresponding to the fee and to the contributions to the Universal Service Fund, even when the principal amount has been already been paid up.
The Resolution establishes 180 calendar days, counted from the day it was published, to adhere to the regime. This period may be extended for another 180 days through an express administrative act. Adhering to the regime implies expressly acknowledging the debt and waving any administrative appeal or court action in connection with the obligations in it.
The regime determines three payment modalities:
- Lump-sum payment, with a 60% reduction in interest and the full elimination of daily fines.
- Payment plan of up to 12 installments, with no amount cap, which requires a 10% down payment and grants a 35% reduction in interest.
- Payment plan of up to 24 installments, applicable to debts of up to ARS 20,000,000, with the same benefits as the 12-installment plan.
Applicants must adhere exclusively through the procedure Application for Payment Plans on the Remote Procedures Platform (TAD).
Finally, the regime provides that the payment plan will be automatically terminated if two installments or the final installment are not paid, or if the applicant undergoes insolvency or bankruptcy proceedings. In this last case, ENACOM will be entitled to demand immediate payment of the outstanding balance and to initiate judicial actions.
