Coronavirus: the government decreed an extraordinary leave for all employees returning from abroad.
The administrative resolution RESOL-2020-178-APN-MT was signed by the Ministry of Labor, Employment and Social Security, Claudio Moroni, during the night of Friday March 6.
In the recitals, the resolution refers to how the disease commonly known as CORONAVIRUS is spreading worldwide from one person to another, and to the recommendations given by the Health Ministry. It highlights the need to isolate the persons to avoid contagiousness, and the need to guarantee the workers´ rights in this context.
In the operative part, the resolution provides an exceptional leave so that the employees that entry the country from abroad remain at home voluntarily (section 1°). It provides that this license shall not affect the workers´ right to receive their “normal and usual” salary, or those additional items arising from legal or collective bargain regulations (section 2°). And it provides that this license shall not affect any other license that the worker has the right to enjoy (section 3°).
The resolution does not provide further details on how long it will remain in place, the duration of the license, or if the place of departure of the employees entering the country shall affect the license or not. Instead, it authorizes the Secretary of Labor to issue the necessary complementary regulations, so clarifications are expected during the following days.
