Strides Towards the Digitalization of Judicial Proceedings

With the aim of modernizing and speeding up the justice system, the provinces of Mendoza and Salta implemented digital proceedings, while the province of Corrientes developed an electronic management software for adversarial criminal proceedings.

  1.  Province of Mendoza:

The Supreme Court of Justice of the Province of Mendoza issued Orders No. 29,815, No. 29,816 and No. 29,818 implementing digital proceedings in the provincial justice system.

To that end, Order No. 29,815 ratified the electronic procedural address associated with a series of provincial and municipal public entities as well as with some frequent litigators where notifications can be validly served electronically (paper-based notice is not necessary).

On its part, Order No. 29,816 established that all documents submitted and signed electronically through the TOC LegalSign platform are legally valid and regarded as electronically signed under section 5 of Law No. 25.506. In that sense, the Supreme Court of Mendoza took into account the positive results of the trial period implemented in Labor Courts, which resulted in a significant reduction in the time and costs incurred both by the judiciary as well as by private parties.

Lastly, Order No. 29,818 established an electronic confirmation of receipt and held that such confirmation is consistent with the requirements set forth in the Procedural Code for confirming receipt in paper.

 

  1.  Province of Salta:

The Salta Court of Justice issued Order No. 13,225 which established the gradual and progressive implementation of a digital proceeding system within the provincial judiciary as of November 9, 2020. To that end, the system will be tested in three Courts of the Province of Salta in an initial trial phase.

 

  1. Province of Corrientes: 

The Information Technology authority of the judiciary system of Corrientes announced the development of an electronic management software for adversarial criminal proceedings called Forum Criminis, which aims to store the legal history of natural and legal persons and provide information on whether they were involved in any criminal, civil, labor, commercial or administrative proceedings.

The system also seeks to reduce paper usage within the judiciary, to create efficient and agile tools, and to promote transparency in judicial proceedings.
