Argentina and Brazil Sign Memorandum on Data Protection

Argentina’s Agency of Access to Public Information (AAIP) and Brazil’s Autoridade Nacional de Proteção de Dados (ANPD) signed a Memorandum of Understanding designed to consolidate bilateral cooperation in the field of personal data protection. This non-binding memorandum seeks to establish a solid institutional basis for mutual assistance, the exchange of regulatory experiences, and coordination in supervision and enforcement actions.

The Memorandum establishes the following areas of cooperation:

  1. collaboration on international data transfers (IDT),
  2. public consultations,
  3. a regulatory sandbox on artificial intelligence,
  4. the exchange of information on ongoing investigations,
  5. the development of joint education, training, and research programs.

The ANPD emphasized the strategic nature of the collaboration, not only because of the political, cultural, and economic ties between the two countries, but also due to Argentina’s position as Brazil’s third-largest trading partner in the region. It also stressed that cooperation with the AAIP contributes to strengthening the international credibility of Brazil’s General Data Protection Law (LGPD) and to advancing greater regulatory harmonization across South America.

The Memorandum consolidates a channel of technical and regulatory cooperation between both data protection authorities, with significant impact on issues such as international data transfers and the regulation of artificial intelligence.
