Argentina Signs Convention 108+
Argentina is the 33rd country to sign the Protocol that modifies the Convention for the Protection of Persons with regard to the Processing of Personal Data.
The Republic of Argentina, which is a party to Convention 108 since June 1, 2019 (for more information see Argentina Accedes to Convention No. 108 on Data Protection), has signed the Protocol that modifies Convention 108, also known as Convention 108+. The new text includes the principles of transparency, proportionality, accountability, data minimization and privacy by design.
Amongst the new guidelines that the Protocol adds to Convention 108, the following stand out:
- Stronger requirements on proportionality and data minimization principles;
- Extension of the types of sensitive data, which now include genetic, biometric data, trade union membership and ethnic origin;
- Obligation to inform data breaches;
- Greater transparency of data processing;
- Stronger accountability of data controllers;
- Requirement that the “privacy by design” principle is applied;
- Specific regime for the international transfer of personal data;
- New attributions and powers to the Convention Committee.
The text of Convention 108+ states that it will be part of Argentine domestic law once it is ratified by the Argentine Congress.
