On February 19, 2018, the Agency of Access to Public Information issued Resolution No. 12/2018 which approves the new design of logos which identify data controllers with registered databases.

New Identifying Logo for Registered Data Controllers

Resolution No. 12/2018 published in the Official Gazette on February 21, 2018, approved the new design of the logos aimed at identifying those data controllers that have their registration approved by Argentine Registry of Data Bases of the Agency of Access to Public Information, the controlling authority of Personal Data Protection Law No. 25,326. A copy of this new design can be found at the end of this article. The new design will replace the previous identifying logo which had been created by regulations enacted by the former supervisory authority, the Argentine Personal Data Protection Agency –Dirección Nacional de Protección de Datos Personales- (see "Databases: authorization for using identifying logos").

The registration of databases is mandatory for all private databases intended to provide information, i.e. those which exceed personal use and/or those that are used to disclose or transfer personal data (including any information referring to individuals or legal entities), whether or not the disclosure of the relevant piece of information is provided for free or is charged.

The registration is annual and must be renewed within 45 days prior to its expiration unless the databases store information on less than 5,000 persons, in which case renewal is not required.

The data controllers that have renewed the registration of their databases are entitled to use the relevant logos on their own website. To that extent they must request the proper authorization to the Agency of Access to Public Information, which, if such petition is granted, must forward the file containing the logo. Once the logo has been installed, the website must be linked to the Agency’s website. The use of the identifying logo is not mandatory.

The aim of using the identifying logo is to provide certainty about the fact that the data controller has complied with Personal Data Protection Law No. 25,236 and its regulation regarding registration of databases.
