2017 Legislative News: Summary

2017 has been an important year in Argentina with significant laws passed by the Congress, several reform initiatives submitted by the Government, and the regulation of some norms approved in 2016. Marval’s lawyers have analyzed these legislative changes in a number of articles published throughout the year in Marval News. Compliance and Anti-corruption

In November, Argentine Congress passed a law on corporate criminal liability. This norm was analyzed in “Corporate Criminal Liability Regime”,  “New law on corporate criminal liability and compliance programs for corruption cases”, “Corporate Criminal Liability and Compliance Programs for Corruption Cases”, and “Corporate Criminal Liability and Compliance Programs’ Bill”.


Labor & Employment

The labor reform is a significant initiative put forward by Argentine Executive Power in 2017. “Labor Reform: Bill Submitted to the Argentine Congress” and “Labor Reform: Amnesty and Moratorium” examine the changes made to the Government proposal  to achieve an agreement with the business chambers and the General Confederation of Labor (“CGT” after its acronym in Spanish). Incidentally, “Labor Reform in Brazil: Differences with Argentina” analyzes the most important changes brought about by the labor reform in Brazil. Modifications to the labor risk regime were addressed as well: “Modifications to the Labor Risk Regime”.


Public and Administrative Law

In 2017, the new regime of Public-Private Partnerships was regulated, and Marval News considered the regulation of different aspects of this regime: “Public-Private Partnership (PPP): Roads and Highways”, “Public-Private Partnership Contracts: Amendment of Regulations”, “New Bill on Trusts in Public-Private Partnership Contracts”, and “Regulations to the Public-Private Partnership Law”. Energy and Natural Resources

Tax

One of the most important initiatives Argentine Government sent to the Congress in 2017 is a tax reform. Capital Markets

On November 14, Argentine Executive Power sent to the Congress a bill to reform Law 26.631. This subject was analyzed in “Bill to Reform the Capital Markets Law”. Already in 2016, several aspects of this reform had been treated in “Bill to Amend the Capital Markets’ Law - Tax Aspects”, “Repos and Derivatives Transactions in the Capital Markets Reform Bill”, and “Bill to Reform the Capital Markets Law”.


Corporate / M&A

The Law to Encourage Entrepreneurship, passed in April 2017, and the regime of simplified corporations derived from it, were treated in several articles: “Amendment of Regulation Regarding Simplified Corporations”, “Tax Treatment of the Entrepreneurship Law”, “Obtention of Tax ID for Simplified Corporations”, “Regulation of Simplified Corporations”, “Support for Entrepreneurial Activity Law, Fiduciary Fund for Entrepreneurial Capital Development and Crowdfunding”, and  “Law to Encourage Entrepreneurship”.
