Databases: authorization for using identifying logos
On February 22, 2008, the Argentine Data Protection Agency issued Disposition No 1/2008 approving the logos which identify those individuals or companies who renewed or will have to renew the registration of a database in 2007 and/or 2008.

The registration of databases is mandatory for all private data files, registries, databases or data banks intended to provide information, i.e. those which exceed personal use and/or those that are used to assign or transfer personal data (including any information referring to individuals or legal entities), whether or not the circulation of the relevant report or the information taken from the databases is provided for free or is charged.

As informed previously, the Argentine Data Protection Agency (the “Agency”) implemented the Argentine Registry of Data Bases (the “Registry”), as of August 1, 2005, by Dispositions No 2/2005 and No 4/2005 (please see Marval News # 37, # 38 and # 39). Furthermore, Disposition No 6/2005 approved the logo that identifies the owner of a database recorded with this Registry.

The registration is annual and must be renewed within 45 days prior to the expiration date.

Pursuant to the new Disposition No 1/2008, use of the approved logos is not mandatory but requires the prior approval of the Authority. The owners of databases who have renewed the registration and are interested in using the logo in their own websites, will be able to request the proper authorization of the Agency to that end. After obtaining such authorization, the Agency will provide with a file containing the logo.

When using this logo in the Internet site, the owner of a registered database must establish a link to the Agency’s webpage that informs the individuals or entities registered in the Registry.
