Procedure for registration of EU Geographical Indications and Appellations of Origin in Argentina
|
|
On November 1 2017, Resolution N° 319-E/2017, issued by the Ministry of Agroindustry, was published in the Official Gazette. The resolution regulates the procedure for the registration of Geographical Indications (GIs) and Appellations of Origin (AOs) from the European Union and reflects the result of the ongoing negotiations between the European Union and MERCOSUR (Common Market of South America), with the aim of signing a free trade agreement.

On June 6, 2017 Division 3 of the Federal Court of Appeals in Civil and Commercial Matters, in re “Dart Industries Inc. v. Crom S.R.L.” (case No. 3769/15/CA1) upheld the district court’s decision to reject the plaintiff’s request to dismiss the counterclaim filed by the defendant seeking to cancel the plaintiff’s industrial designs.

On February 13, 2017 Division 3 of the Federal Court of Appeals on Civil and Commercial Matters confirmed the first instance decision dismissing an opposition filed by the defendant Nicolás Schnaider on the basis of his trademark “WAYRA” covering only “rental of automatic distributors, newspaper cuttings, personal selection through psycho-technical procedures” in Class 35 against trademark application “WAYRA” filed by the plaintiff Víctor Villamayor in Classes 36 and 45.

On May 16, 2017 Division 3 of the Federal Court of Appeals in Civil and Commercial Matters, in re “Nike Argentina S.R.L. v. Pace, Susana” (Case No. 4176/08), reversed the district court’s decision that had cancelled the trademark registration for “ZOOM” (design) in Class 25, but upheld it with respect to the counterclaim filed by the defendant seeking that use of the trademark be discontinued plus damages.

Being Well-Known was not Enough |
|
On December 13, 2016 Division 1 of the Federal Court of Appeals on Civil and Commercial Matters declared that trademark application “LA MARTINA TRADICIÓN DEL POLO ARGENTINO” filed by Mr. Lando Simonetti in Class 33 was confusingly similar to the opposing mark “FINCA LA MARTINA” granted in the same class to cover only “premium and high range sparkling wines”, considering that the mot vedette of the trademark applied for was “La Martina” thus conferring less distinctiveness to the other elements and strongly bringing the marks at stake closer. (Case 4405/2011, “Simonetti, Lando v. Reyter SRL”).

On November 8, 2017, Division 2 of the Federal Court of Appeals on Civil and Commercial Matters upheld the first instance decision and declared the opposition filed by Kraft Foods Argentina against the trademark application “MAIZENA EXPRESS” for “a thickening agent for cooking foodstuff” in International Class 30 (“Conopco Inc v. Kraft Foods Argentina”) to be groundless.

Imminent Danger and Inactivity by the Interested Party results in Rejection of Preliminary Injunction |
|
On June 22, 2017 in re “Asociación Argentina de Farmacia y Bioquímica Industrial v. Sindicato Argentino de Farmacéuticos y Bioquímicos” (case No. 690/2017), Division 1 of the Federal Court of Appeals in Civil and Commercial Matters reversed the district court’s decision and dismissed the preliminary injunction sought by the plaintiff to enjoin use of the acronym “SAFYB”. The decision was based on grounds of non-urgency and on the fact that there was no risk regarding the effectiveness of the judgment.

Procedimiento para el registro en la Argentina de Indicaciones Geográficas y Denominaciones de Origen de la Unión Europea

El 1 de noviembre de 2017, se publicó en el Boletín Oficial la Resolución N° 319-E/2017, dictada por el Ministerio de Agroindustria. La Resolución regula el procedimiento para el registro de las Indicaciones Geográficas (IG) y Denominaciones de Origen (DO) de la Unión Europea, y refleja el resultado de las negociaciones entre la Unión Europea y el Mercado Común del Sur (MERCOSUR) con el objeto de firmar un acuerdo de libre comercio.

El 6 de junio de 2017, la Sala 3 de la Cámara Nacional de Apelaciones en lo Civil y Comercial Federal, en los autos “Dart Industries Inc. c/ Crom SRL s/ Cese de uso de modelos y diseños – Daños y perjuicios” (causa 3769/15/CA1), confirmó la sentencia de primera instancia que había resuelto diferir para el momento de la sentencia definitiva la excepción de prescripción interpuesta por la actora.

|
|
El 13 de febrero de 2017, la Sala 3 de la Cámara Civil y Comercial Federal confirmó el fallo de primera instancia al declarar infundada la oposición realizada por el demandado Nicolás Schnaider, sobre la base de su marca “WAYRA” limitada en la clase 35 a únicamente “alquiler de distribuidores automáticos, recortes de diario, selección de personal por procedimientos psicotécnicos”, contra el registro de la marca “WAYRA” pretendido por el actor Víctor Villamayor en las clases 36 y 45, por considerar que no se configuraban hechos fácticos que justificaran apartarse del principio de especialidad que rige en materia marcaria (causa 3382/13/CAI, “Villamayor, Víctor Daniel c/ Schnaider, Diego”).

|
|
El 16 de mayo de 2017, la Sala 3 de la Cámara Nacional de Apelaciones en lo Civil y Comercial Federal, en los autos “Nike Argentina SRL c/ Pace, Susana s/ Nulidad de marca” (causa N° 4.176/08), revocó la sentencia de primera instancia que había declarado la nulidad de la marca “ZOOM” (mixta) de la clase 25, y la confirmó en cuanto al rechazo de la reconvención por cese de uso y daños y perjuicios interpuesto por la demandada.

La notoriedad de una marca en una clase no evita necesariamente la confusión en otra clase distinta
|
|
El 13 de diciembre de 2016, la Sala 1 de la Cámara Civil y Comercial Federal declaró que la marca “LA MARTINA TRADICIÓN DEL POLO ARGENTINO”, solicitada por Lando Simonetti en la clase 33, era confundible con la marca oponente “FINCA LA MARTINA”, registrada en la misma clase para distinguir “vinos premium y espumantes de alta gama”, a nombre del demandado Reyters SRL, por entender que el elemento preponderante del conjunto marcario pretendido era “La Martina”, lo cual restaba poder diferenciador a los restantes elementos y acercaba enormemente las marcas en pugna (causa 4405/2011, “Simonetti, Lando c/ Reyter SRL”).

Con fecha 8 de noviembre de 2016, en los autos “Conopco Inc c/ Kraft Foods Argentina s/ Cese de oposición al registro de marca”, la Sala 2 de la Cámara Nacional de Apelaciones en lo Civil y Comercial Federal confirmó la sentencia de primera instancia y declaró infundada la oposición presentada por Kraft Foods Argentina contra la solicitud de marca “MAIZENA EXPRESS” para distinguir un “agente espesante para cocinar alimentos” en la clase 30 internacional.

Medidas cautelares: el peligro en la demora y la inactividad de la parte interesada
|
|
El 22 de junio de 2017, en los autos “Asociación Argentina de Farmacia y Bioquímica Industrial c/ Sindicato Argentino de Farmacéuticos y Bioquímicos s/ Medidas cautelares” (Causa N° 690/2017), la Sala 1 de la Cámara Nacional de Apelaciones en lo Civil y Comercial Federal revocó la sentencia de primera instancia y desestimó la procedencia de la medida cautelar de cese de uso de la sigla “SAFYB” solicitada por la Asociación, por considerar que no existían razones de urgencia ni de peligro en la demora.
